Terms of Service and Arbitration Agreement
Binding Arbitration (“Arbitration Agreement”)
a. Applicability of Arbitration Agreement
You agree that any dispute or claim against us, or our vendors or service providers (collectively, “We” or “Us”), related in any way to your access or use of this website, to these Terms, or to any aspect of your relationship with Us, will be resolved by binding arbitration, rather than in court, except that (1) you may assert claims in small claims court if your claims qualify, so long as the matter remains in such court and advances only on an individual (non-class, non-representative) basis; and (2) you or We may seek equitable relief in court for infringement or other misuse of intellectual property rights (such as trademarks, trade dress, domain names, trade secrets, copyrights, and patents).

If a resolution is not reached within thirty (30) days, you may commence an arbitration with JAMS following their Streamlined or Comprehensive Arbitration Rules (www.jamsadr.com). You may choose to have arbitration conducted remotely or in person at a mutually agreed location.
c. Fees
If the arbitrator finds that you cannot afford JAMS fees, and you cannot obtain a waiver, we will pay them for you. If the arbitrator determines your claims are frivolous, you agree to reimburse our attorneys’ fees and costs to the extent permitted by law.
d. Authority of Arbitrator
The arbitrator will have exclusive authority to interpret, enforce, or decide disputes relating to this Arbitration Agreement. The arbitrator may award any relief available under applicable law and must issue a written award explaining the decision.
e. Waiver of Jury Trial
You and We waive any right to a jury trial.
f. Waiver of Class or Consolidated Actions
All claims must be arbitrated individually, not as part of a class or consolidated proceeding.
g. Batch Arbitration
If 50 or more similar individual arbitration requests are filed within a 30-day period, JAMS may administer them collectively as a single “Batch Arbitration.”
h. Severability
If any part of this Arbitration Agreement is found invalid, the remainder will continue in full effect.
i. Survival
This Arbitration Agreement survives the termination of your relationship with Us.
j. Modification
If we make future material changes to this Arbitration Agreement, such changes will not apply to any dispute you already notified us about.
